Privacy policy

As part of our Auction Brokerage Platform, Load & Pay takes your privacy and the protection of your personal data very seriously and takes all reasonable precautions to do so. To this end, we have prepared two documents to inform you about how we collect, use and protect your personal data in the context of our various services:


These policies are designed to inform you about what we do with the personal data and information you choose to share with us, why we collect it and how we keep it secure.

The term "we" or "us" as used in this Privacy Policy refers to Load & Pay 

In the following, we use the terms "personal data", "personal data" and "personal information" to refer to information that identifies you personally (surnames, first names, business addresses, etc.) or, as in this case, data that is linked to you (answers to questions on the form), as well as data on your connection to our site (if applicable, IP address, date and time of connection) and data on your browsing of our platform.

1.  Who are we?

Load & Pay is a simplified joint stock company with a capital of 10,000 euros, registered in the Vienne trade and companies register under number 901 160 994, whose registered office is located at 30 avenue Alexandre Flemming, 38 300 Bourgoin-Jallieu, France.

We are the data controller within the meaning of Regulation (EU) 2016/679 of the General Data Protection Regulation (hereinafter "GDPR"), for the collection and processing of personal data carried out on our Platform, including accessible from our website www.loadandpay.com.

2.  What data do we collect about you and why do we process your data? 

The personal information you choose to provide to us on our sites will only be processed for the following purposes:

In reliance on the performance of a contract to which you, or the company employing you on a business account, are a party, in order to          

  • proceed to the creation of your user accounts to our Platform;
  • and to enable the use of it in accordance with the services we provide under our T&Cs such as offering for sale a Vehicle or bidding or selling a Vehicle or assisting you in using our Platform.


It is thus about data concerning you and allowing:

  • to identify you or the company that employs you, such as your name, first name, email address, telephone number and country of residence, a copy of an official identity document, if applicable your professional email address, your company name, your registration in the trade register or your intra-community VAT number if you have one;
  • identify the Vehicle which is the subject of the Offer, such as the Vehicle registration certificate or any information and photographs relating to that Vehicle and any exchanges you may have via the Platform in this regard.


If you are a consumer, based on your consent, in case you have given it to us, to subscribe to our newsletters and content sent by email that are not directly related to the execution of our T&Cs: This is your email address.

If you are a professional, based on the legal basis of our legitimate interest, to subscribe to our newsletters and content sent by email that are not directly related to the execution of our T&Cs: This is your business email address.

Based on the legal basis of our legitimate interest in providing you with a quality and secure service, which is always as close as possible to your expectations in order to:

  • optimize the functioning of our Platform according to your profile or that of your company;
  • evaluate and develop new features, technologies and improvements to the services available on the Platform;
  • for other internal, research or statistical purposes;
  • to strengthen our data security and fraud prevention capabilities;
  • to investigate possible violations, enforce our terms or policies, or in the event of pre-litigation/litigation to defend our rights in court;


This includes the data previously listed, as well as your IP address, date and time of connection.

Based on the legal basis of the legal obligation, to meet such legal or regulatory obligations:

This is potentially all of the data listed above.

3.  To whom can my data be communicated?

The very purpose of our Platform is an intermediation service within the framework of an online auction brokerage. Therefore, by accepting the Platform's T&Cs, you necessarily agree to assume the roles of Seller, Bidder or Designated Bidder respectively, which the Platform automatically transmits:

  • when you are a Seller, the transmission to all Users of information allowing you to be identified on the platform (with the exception of documents allowing to prove the veracity of this information on the one hand and information allowing to contact you directly on the other hand);
    when you are a Bidder, the display of information identifying you on the Platform from this same platform;
  • when the auction has been won by a Designated Bidder, the transmission of contact information from the Designated Bidder to the Seller and from the Seller to the Designated Bidder;


Apart from these cases, Load & Pay does not communicate your personal data:

  • in response to judicial or administrative proceedings of any kind or to law enforcement measures requested by the competent authorities;
  • or to our service providers, for example, to store it in third-party hosting services, providing our technical support, etc.
  • or to our service providers within the framework of their mission and within the strict limits of the information necessary for their mission (lawyer, chartered accountant, etc.).


We require all such third parties to apply at least the basic security rules defined by the CNIL in terms of administrative, technical and organisational aspects in order to protect your shared data from unlawful disclosure, use, modification and destruction.

In particular, we have rigorously selected our subcontractors according to the security of the hosting they provide. 

For example, we work with service providers who work on our behalf and who may need access to some of your personal data in order to provide us with support or operate the technical infrastructure we need to provide our services.

Your data may thus be transmitted to the following subcontractors:

  • Amazon Web Services, for the hosting of our platform, on servers located within the European Union;
  • RCA, for issuing invoices for our brokerage fees;
  • Our financial partners, for the secure payment of our brokerage fees (Stripe and CIC Lyonnaise de Banque);
  • Mailchimp, for the subscription to our sales alerts.


It is possible that, in some cases, the efficient processing of your data by our subcontractors may involve processing outside the European Union. In these cases, we have provided for ad hoc contractual clauses, recognised by the European Commission, to protect your data at least as well as if it were processed in France.

In addition, if you decide to use your social network accounts to share content or to connect to our site, this connection may allow the transmission of certain data to servers used by these services, particularly in the United States. To find out more, please click below.

4.  What about social networks?

In order to provide you with the most complete service, we have provided you with the ability to easily share the pages you visit on your favorite social networks. The use of the buttons allowing access to social networks is likely to lead to the collection and exchange of certain data between the social networks and our site.

Our site thus uses "plug-ins" or social modules on certain pages ("share" buttons from third-party social networks such as Facebook, Instagram, LinkedIn). When you visit a page on our site containing such social modules, a connection is automatically established with the servers of the social networks, which may then be informed that you have accessed the corresponding page on our site. If you wish to limit the information published or known by these social networks concerning your actions on our site, we advise you to disconnect from your social networks before visiting our site.

In order to protect your privacy, however, we have limited the information that is automatically transmitted in this way.

In this context:

  • Load & Pay only collects the fact that you have logged into the social network in question;
  • The social network in question collects information that is specified in their own personal information protection policy, which we invite you to consult and on which you can act in the settings of each social network;
  • Load & Pay is not responsible for the use that is made of your data by these social networks for their own account.


To conclude on this issue, we inform you that the information transmitted to the various social networks under the conditions we have mentioned may be transmitted and processed by these companies via their servers located in several countries around the world, including the United States, in accordance with their own privacy policies, which we invite you to read.

5.  How long will your data be kept?  

Your data is kept for the time necessary to achieve the purposes described above and in compliance with the legislation in force.

With regard to commercial prospecting data in the event that you have not signed up for our services, we keep personal data in an active database for the time necessary to follow up our commercial relationship with you, i.e. three years from our last contact.

If you have opened an account on our Platform, we keep the personal data concerning the T&Cs that binds us in an active database for the time necessary to follow our commercial relationship with you, then in an intermediate database for five years after the end of the contract. 

However, the data allowing to establish the proof of a right or a contract, having to be preserved under the respect of a legal obligation, will be it during the duration envisaged by the law in force, in intermediate file 

Connection data (IP address, date and time of connection, pages consulted) are kept for up to 12 months.

At the end of these periods, they are then archived, anonymized or deleted.

6.  Where is your data stored?

Your data is stored within the European Union as a matter of principle 

In the event that the recipient of a personal data flow is located outside the European Union, or in a country that does not have an adequate level of protection within the meaning of the Regulation on the protection of individuals with regard to the processing of personal data and on the free movement of such data, these transfers of personal data will be carried out on the basis of the European Commission's standard contractual clauses and/or any other legal basis that complies with the applicable legislation on the protection of personal data constituting "appropriate safeguards" within the meaning of the GDPR. 

In particular, with regard to our subcontractors Stripe and Mailchimp, transfers to the United States are governed by the European Commission's standard contractual clauses 

7.  How is your data protected?

The data host we use stores your information on secure servers. Our website benefits from the SSL certificate, activating the "https" protocol capable of securing the connection between the web server and the browser. We use appropriate security measures to ensure optimal security of the documents.

We always do our utmost to protect your personal data. From the moment we receive your data and throughout its life cycle, we apply strict procedures and security measures to ensure its availability, integrity and to prevent unauthorized access 

8.  What are your rights?

In accordance with Article 13 and Articles 15 to 22 of the GDPR, we will endeavour to enable you to exercise your rights in relation to the personal data you entrust to us. As such, and within the limits provided for by the texts, you benefit from the possibility:

  • to be informed in a comprehensible way about the processing of your data that is carried out;
  • to request access to your data;
  • to request that your inaccurate or incomplete data be corrected;
  • to request the deletion of your data;
  • to object to or request a restriction of the processing of your data;
  • to exercise your right to the portability of your data concerning the data collected on the Offers and the exchanges during the auction processes;
  • to provide instructions on the retention, deletion and disclosure of your personal data after your death;
    to withdraw your consent to data processing at any time insofar as consent is the legal basis for the processing in question, i.e. in relation to subscriptions to our newsletters.

To protect your privacy and security and in case of doubt, we may ask you to provide proof of your identity.

10.  Privacy Policy Updates

We may update this Privacy Policy at any time to reflect new practices and service offerings. In this case, the date of the update of the Data Protection Policy will be updated and will indicate the day on which the changes were made. In the event of significant changes, we will post a notice on our Platform to announce these changes
